Preamble

This contract constitutes a legal agreement between the user of the hotelsjobs.ca website (hereinafter referred to as the "site") regarding the use of said "site".

PLEASE READ THESE CONDITIONS CAREFULLY BEFORE ACCESSING THE SITE

By browsing the "site", you agree to be bound by the Terms of Use and Display Terms of this contract, for as long as you are on the site.

The terms and provisions of the contract may change at any time and they will automatically come into effect.

1. Acceptance of Terms of Use and Display Terms

By using the services offered by hotelsjobs.ca, you accept these terms of use and display terms, as well as the conditions associated with managing potential modifications. We therefore suggest that you periodically consult these Terms of Use and Terms to stay well informed and accept updates to said terms and conditions.

2. Services offered by hotelsjobs.ca

Hotelsjobs.ca is a one-stop shop for everything related to the world of work: job offers, job search assistance, as well as other information.

On hotelsjobs.ca, you can find detailed descriptions of positions offered by several companies and organizations. Hotelsjobs.ca also offers service providers and companies a powerful tool for disseminating their service offers and job opportunities.

3. Copyright and Trademarks

The hotelsjobs.ca logo and all its variations, the navigation tool and all content of hotelsjobs.ca are offered for non-commercial purposes. It is forbidden to use the logo or information contained in hotelsjobs.ca for commercial or advertising purposes or to increase the volume of visitors to another site without the prior written authorization of hotelsjobs.ca.

Hotelsjobs.ca and other names, logos and icons related to hotelsjobs.ca products and services are trademarks. Unless clearly stated exceptions, nothing in our service should be interpreted as granting you any right to use hotelsjobs.ca's intellectual property.

You are prohibited from modifying, copying, distributing, transmitting, broadcasting, representing, reproducing, publishing, licensing, transferring or selling any information, software, product or service obtained from the site, or creating derivative works from the aforementioned elements.

4. Username, Password

You are responsible for the confidentiality of your username and password; hotelsjobs.ca cannot at any time be held responsible for unauthorized use of your account. In the event that the confidentiality of this information is compromised, please contact hotelsjobs.ca by email as soon as possible to avoid potential fraudulent use of your identity. Hotelsjobs.ca will not be held responsible for any damage or loss resulting from, in particular, non-compliance with the security measures set out in this section. We strongly recommend that you consult the LIMITATION OF LIABILITY contained in clause 6 of these Terms of Use and Display Terms to inform yourself about the extent of your responsibilities regarding hotelsjobs.ca services.

5. Use of Online Communication Services

You are solely responsible for the content of the messages you broadcast through our service and the consequences of these messages. You must not use this service to promote or offer for sale any goods or services for commercial purposes, conduct or send: study, contest, pyramid scheme or chain letter, spam, perform hacking, solicitation or perform any other act for illegal purposes. You are also prohibited from performing acts that could infringe on the rights of others as well as their enjoyment of the service. Activated services and packages must be used within the time limits prescribed by your package. No refund will be granted for unused services.

Although hotelsjobs.ca reserves the right to delete certain data, all at its own discretion, this remains a faculty and not an obligation. Hotelsjobs.ca makes no representation regarding the control of the content of the information available, given the volume and speed of data transmission on the service.

6. Limitation of Liability

Search engines, directories and content are offered free of charge by hotelsjobs.ca without any guarantee as to the accuracy or availability of the sites. Moreover, hotelsjobs.ca makes no representation as to the exhaustive nature of the results of your searches. The information contained on the Internet is constantly evolving, as are the sites that present it. It is therefore impossible to make complete updates at all times. Hotelsjobs.ca cannot therefore be held responsible for the lack of exhaustiveness of a search or the lack of accessibility of a given site.

Furthermore, hotelsjobs.ca cannot guarantee the confidentiality of information transmitted over the Internet and cannot be held responsible for any damage caused by their disclosure, unless otherwise stated.

You hereby accept that hotelsjobs.ca cannot be held responsible for any damage suffered, whether direct or indirect, resulting from the use of its services. You further agree that all information contained in our sites is offered as is without any guarantee as to the accuracy or reliability of the content.

7. Network Security and Efficiency

The hotelsjobs.ca site may experience occasional outages and certain programming errors may be caused by updates or by events beyond the control of the administrators. Neither the administrators nor any member of the organization can be held responsible if a member is unable to navigate the "site", regardless of the reason preventing them (misunderstanding, defective telephone line, incompatible modem, broken cable, bad configuration, wrong browser, etc.).

8. Content Ownership

You remain the copyright holder of the content you submit to our service. However, you grant hotelsjobs.ca a license to use this content for dissemination and promotion purposes. This license is granted to hotelsjobs.ca by the mere act of submitting your content to our services and is offered free of charge, non-exclusively and for perpetual application. This license includes, among other things, the right to use, reproduce, copy, in whole or in part, and display the content in our services, except when expressly excluded.

You also agree that hotelsjobs.ca reserves the right to remove from its network information whose content is deemed inappropriate or that contravenes these Terms of Use and Display Terms.

9. Breach of Terms of Use and Display Terms

These Terms of Use and Display Terms are put in place to protect our users and maintain the quality of the service. Be aware that any failure on your part to comply with the Terms of Use and Display Terms established herein may lead to the elimination of your link to hotelsjobs.ca.

10. Applicable Law

This agreement on the terms of service is governed by the laws applicable in the province of Quebec. You hereby acknowledge that any dispute arising from, or related to the use of hotelsjobs.ca services and site will be subject to the jurisdiction of the courts of the district of Montreal, province of Quebec.

11. Indemnification

You hereby agree to take up the defense of hotelsjobs.ca in the event that legal proceedings are brought against it following a violation of these terms of service by you or any user of your link to hotelsjobs.ca.

12. Job Posting and Advertising for Employers

1. Terms of Use

Hotelsjobs.ca – Jobs: only one type of job offer per posting and per broadcast. Services must be used within the indicated period.

Hotelsjobs.ca – Jobs: a job posting must represent a real opportunity in your organization. No postings concerning calls for tenders or candidate banks will be tolerated on said sites. We reserve the right to delete the offer that seems to "not meet this condition", without refund.

Hotelsjobs.ca – Training: only one type of course per posting and per broadcast. Services must be used within the indicated period.

Web products: impressions subject to availability. We reserve the right to modify our advertising products by notifying you at least 30 days in advance. The agreement does not include the creation of your advertising material. Advertising material must be provided in the language of the site in which it will appear. Gif, jpeg files and hyperlinks must be received no later than 5 working days before the start of the campaign. If the material is not received within the allotted time, hotelsjobs.ca cannot guarantee delivery according to the signed agreement.

2. Cancellation Conditions

A penalty fee of 50% of the total invoice will be charged in case of cancellation of any unlimited package before the expiry date of said contract.

No cancellation before the start date.

No cancellation after the start date of the advertising campaign or job posting will be refunded.

3. Payment

The invoice is payable upon receipt.

To avoid any late fee and deactivation of your account, please ensure that your payment reaches us no later than 30 days after receipt of the invoice (late fee: 2% per month, for a maximum of 25.82% per month, reactivation fee: $150).

No job offer will be refunded once the position is posted.

All packages are automatically renewed upon expiration. Cancellation of a renewal must be communicated before the automatic renewal, otherwise the package must be paid in full.

4. Subscription

Products and services are purchased in the form of subscriptions for the duration indicated at the time of payment.

Subscriptions can be added during a subscription period at the same price as the subscription price, prorated for the part of this subscription duration remaining at the time the subscriptions are added, and

Any added subscription will end on the same date as the underlying subscriptions.

13. Terms of Use for External Recruiters (Recruitment Firms)

1. Terms of Use

Hotelsjobs.ca – Jobs: only one type of job offer per posting and per broadcast. Services must be used within the indicated period.

Hotelsjobs.ca – Jobs: a job posting must represent a real opportunity with your client. No postings concerning calls for tenders, candidate banks or general offers evoking the opening of several different positions will be tolerated on said sites. We reserve the right to delete the offer that seems to "not meet this condition", without refund.

Hotelsjobs.ca – Jobs: A maximum of three offers per week per recruitment firm. Note that job offers posted with your clients' logos are not limited.

Hotelsjobs.ca – Jobs: The prices in the online store are applicable for employers who hire internally only. These prices are therefore not applicable for placement/recruitment firms that would like to post for one of their clients.

Hotelsjobs.ca – Training: only one type of course per posting and per broadcast. Services must be used within the indicated period.

4. Subscription

Products and services are purchased in the form of subscriptions for the duration indicated at the time of payment. A minimum of 3 months of use is required for any new subscription.

Subscriptions can be added during a subscription period at the same price as the subscription price, prorated for the part of this subscription duration remaining at the time the subscriptions are added, and

Any added subscription will end on the same date as the underlying subscriptions.

14. Display Language

According to Article 41 of the Charter of the French Language, all job offers for positions established in Quebec must be published in French (full content).

"According to the terms of the Charter of the French Language, which has been law in Quebec since 1977, French is the official language of Quebec. Consequently, any company that owns or wishes to establish a place of business in Quebec must comply with the requirements of the Charter. Anyone who contravenes a provision of the law or regulations adopted by the government under it commits an offense and is liable to requests for corrections from the Office québécois de la langue française, and possibly to prosecution. Hotelsjobs.ca invites you to respect the law by including a complete description of your position in French."

15. Conditions Relating to the Use of Links

Hotelsjobs.ca authorizes and encourages the presence of links to its Web homepage. You can establish a link that refers to the hotelsjobs.ca site if you accept the conditions applicable to links (the "Conditions Applicable to Links") described below. By establishing such a link, you automatically accept these conditions:

If you establish a link with its site, hotelsjobs.ca grants you a limited, non-exclusive, non-transferable and royalty-free license that authorizes you to use the hotelsjobs.ca trademark and Internet icons, if available, (hereinafter referred to as the "Authorized Marks") for the sole purpose of serving as a link between your website and that of hotelsjobs.ca. With the exception of the limited license authorizing you to use the Authorized Marks granted to you under this paragraph, it is strictly forbidden to use hotelsjobs.ca trademarks or service marks (the "Marks") for any reason without the prior written permission of hotelsjobs.ca.

You acknowledge that all rights to the Marks, the content appearing on the hotelsjobs.ca website pages and the presentation of the web pages belong to hotelsjobs.ca. You must not at any time, whether directly or indirectly, contest or violate these rights.

If you establish a link with the hotelsjobs.ca site, your website:

  • cannot create frames intended to surround any part of the site or use other techniques that affect the visual integrity of the site;
  • cannot imply that hotelsjobs.ca recommends you or your products or services.
  • cannot suggest an affiliation between your company and hotelsjobs.ca without the prior written consent of hotelsjobs.ca;
  • cannot misrepresent the relationship between you and hotelsjobs.ca or present false or misleading impressions regarding hotelsjobs.ca services and
  • cannot contain material that could be interpreted as unpleasant or offensive, but material that may be suitable for all age groups.

Hotelsjobs.ca reserves the right to export any links it deems relevant to its site (homepage, positions, directory, etc.).

Hotelsjobs.ca assumes no responsibility for the content appearing on your website.

Hotelsjobs.ca may at any time and at its sole discretion, immediately terminate your license authorizing you to use the Authorized Marks and your right to establish a link with its site, with or without reason. If hotelsjobs.ca exercises this right, you must immediately remove all links to its site and cease using the Authorized Marks.

16. Conditions Relating to the Integration of XML Feed or RSS Feed

If you use an XML feed or RSS feed for hotelsjobs.ca to publish your offers automatically, hotelsjobs.ca cannot guarantee that the execution will be perfect at all times.

Note that if you modify your ATS provider or change anything on your career page, in your RSS feed or your XML feed, the integration will have to be redone and Hotelsjobs.ca will have to bill you for the service.

This is a new condition.

It is agreed that these Terms and Display Terms may be modified in whole or in part by hotelsjobs.ca at any time, without prior notice. By continuing your steps and your navigation on the "site", you agree to comply with said Terms of Use and Display Terms defined in the Terms of Use and Display Terms page of the Hotelsjobs.ca site.

17. Conditions Relating to Candidates

By accepting these conditions, you confirm that you are looking for a job and agree to receive job offers that may interest you, through any means of communication that you enter on the platform.
